Terms & Conditions
This agreement provides a software service for managing bookings and customer appointments through the Mahjoz system, and is not a sale of the software. By agreeing to these terms, you commit to all provisions and clauses contained herein, in addition to any future amendments to this agreement which are determined from time to time, and the subscriber will be notified accordingly.
Definitions
- Service Provider: Mahjoz Company.
- Subscriber: The individual/organization/company wishing to benefit from the provided service.
- Plan: One of the service versions, each containing its own pricing and features.
- Service: The booking and customer appointment management service via the Mahjoz cloud system.
- Website: The organization/company/individual's website hosted on the internet.
- Software: The Mahjoz program for managing bookings and customer appointments.
1- Subscription and Renewal
To subscribe to any Mahjoz plan, the subscriber requests a subscription after registering in the software, then pays the electronic invoice, upon which the system is activated. When the plan expires, they may renew and choose any available plan and transfer the amount for activation after the transfer.
2- Subscription Duration
The subscription period starts from the activation date of the paid plan and lasts for one calendar year unless the subscriber breaches this agreement (for annual plans) or one calendar month (for monthly plans).
3- Plan Changes and Upgrades
If the subscriber wishes to change plans after the subscription expires, they will pay the fees for the new plan chosen. If before expiration and requesting an upgrade, they will pay the difference for the new plan for the remaining subscription period.
4- Refunds
The subscriber has the right to a refund within seven (7) days of plan activation for new annual subscriptions only at the original price without discounts or offers, provided they have not received any training sessions, support, or data upload and account setup. This clause does not apply to subscription renewals, and the subscriber may not claim any amounts from the service provider if the period exceeds this.
5- Technical Support
The service provider provides technical support to the subscriber through available communication channels during official working hours at no cost to the subscriber. Support includes:
- Resolving any errors or issues that may arise during software use.
- Software upgrades and updates to improve the program and add features.
- Answering questions and inquiries.
6- Maintenance
When the service provider needs to perform maintenance on the software from time to time to add developments and improvements to the service, maintenance may be accompanied by temporary service interruption.
7- Paid Plan Subscriber Data
The service provider commits to preserving and providing subscriber data for the duration of their subscription. If the subscriber wishes to stop using the software for any reason, the service provider will allow access to the software for fifteen (15) days with all features of the selected plan so the subscriber can access and export their data. After this period, the service provider will delete the subscriber's data and provides no guarantees for data recovery thereafter.
8- Security Measures
The subscriber commits to not harming the service provider's website or services, including sending unauthorized requests to attempt to disable or overload them. If any user is found tampering with the provided service, the service provider has the right to suspend their subscription without prior notice, in addition to legally pursuing whoever causes harm to the website, who will bear all costs and expenses related to the case including attorney fees. Therefore, the service provider urges subscribers to protect their confidential login credentials for their program accounts to prevent unauthorized access, as this may expose them to legal prosecution. The service provider is not responsible for subscribers failing to take necessary precautions to protect their private data.
9- Subscription Termination
If the subscriber wishes to terminate their subscription before the plan period ends, the provisions of clause four (Refunds) apply. If after the plan period ends, non-payment of plan fees constitutes termination. Regarding data, refer to clause seven (Subscriber Data).
10- Privacy
The service provider is committed to respecting the privacy of plan subscribers and maintaining the confidentiality of all data they have entered, and will not access their accounts except at the subscriber's request after providing login credentials for any purpose the subscriber needs that requires the service provider's access.
Regarding data used by the service provider for statistics that does not disclose any private information or data, the service provider has the right to use it to measure and improve program performance.
11- Service Provider Discontinuation
In the event the service provider ceases operations:
1- Acquisition by another company: Management transfers to the acquiring company, and the software and all subscriptions become its property, with the option to continue this agreement or make changes as it sees fit.
In this case, the service provider commits to notifying the subscriber before ownership transfer. If the subscriber's plan has not expired at that time, the service provider will obligate the acquiring company to honor the agreement until the subscriber's plan period ends.
2- Inability to continue operations.
In this case, the service provider commits to notifying the subscriber of the available period to export their data.
